Strata Management Act 2013 + ST GP/ST/No.54/2025

Two pieces of Malaysian law govern almost every condo EV-charging decision. If you understand both, the JMB conversation becomes a process, not a fight.

Strata Management Act 2013 (Act 757)

The Strata Management Act 2013 ("SMA 2013") gives the Joint Management Body (JMB) or Management Corporation (MC) authority over common property and shared services — including the building's electrical risers, common-area meters, and any infrastructure that affects fire egress or shared safety. Section 21 sets out the JMB's duties; Section 59 covers the Management Corporation's duties once strata titles are issued; and the prescribed by-laws sit in the Third Schedule of the Strata Management (Maintenance and Management) Regulations 2015, with additional by-laws able to be passed at general meeting.

For EV charging specifically, three SMA 2013 principles drive what a JMB can and cannot do:

  1. Reasonable consent. A JMB cannot unreasonably withhold approval for an alteration to a parking bay or a tap-off from a unit's own supply, provided safety, capacity, and aesthetics are addressed. Blanket refusals without documented reasoning are exposed to challenge at the Strata Management Tribunal under Section 105.

  2. Common property changes need a resolution. If the install touches common-area infrastructure (a new sub-meter on the riser, a shared charger in visitor parking, a load-management cabinet in the M&E room), the JMB needs an ordinary or special resolution depending on what the by-laws specify. Private-bay installs that tap a unit's own DB typically do not need a resolution — a written consent letter is enough.

  3. By-laws can be added at AGM. Many JMBs are now passing "EV charging by-laws" that pre-approve a standard installation specification. This is the cleanest path: one by-law, one approved installer panel, and any resident who meets the spec gets a fast-track approval.​

ST guidelines: GP/ST/No.54/2025

Suruhanjaya Tenaga (the Energy Commission, "ST") regulates everything electrical in Malaysia, including EV charging bays (EVCBs). The current ST guideline for EV charging systems, GP/ST/No.54/2025, sets out the electrical, protection, and licensing rules:

  1. Licensing. A private AC charger up to 22kW for the owner's own use does not require an EVCS licence — in a condo the practical approval is written consent from the management office (JMB/MC), with the TNB/electrical submission handled by a competent person. DC chargers and any communal or public-access charger require Charge Point Operator (CPO) registration and EVCS licensing.

  2. Placement. DC chargers restricted to ground floor and the first two upper levels, or the first basement, mainly for fire-egress and ventilation. AC chargers up to 22kW have no level restriction.

  3. Protection and certification. SIRIM-certified materials, an ST-certified installer, and RCD Type B for any install where the charger produces smooth DC residual currents.

  4. Bomba submission for shared or public installations under the 2023 commercial EV charging guidelines, referenced and aligned in GP/ST/No.54/2025.

One common point of confusion: the 2% EVCB allocation for new developments — providing a share of parking as EV charging bays at building-plan stage — is a separate town-planning rule set by PLANMalaysia's Planning Guidelines for Electric Vehicle Charging Bay (the GPP-EVCB series), not by the ST electrical guideline. A developer must satisfy both: the planning allocation at submission, and ST electrical and licensing requirements at install.

The single most useful distinction: a private-bay charger on your own unit's TNB account = notification only. A communal or shared-revenue charger = Charge Point Operator licensing, Bomba submission, and a JMB resolution. Most condo residents we install for fall into the first category — and most JMB confusion comes from treating both as the same project.

What Your JMB Can and Cannot Refuse

Approvals for strata properties are governed by Malaysia's strata management legislation. Many JMBs are simply unfamiliar with EV charger installations, and an initial refusal is common — but a refusal should still be reasonable and justified.

Common reasons JMBs give for refusing

  • Concern about untidy cabling on car park ceilings

  • No way to bill the electricity back to the individual user

  • Fear of overloading the building's distribution board

  • "Wait until more residents own EVs"

  • Uncertainty about safety and liability

Most of these are solvable technically rather than being genuine blockers. Separate metering handles billing, load management protects the building's supply, and proper trunking keeps the installation tidy. A well-prepared proposal addresses each concern before the committee has to raise it.

If Your JMB Refuses

  • Ask for the refusal in writing, with reasons. A documented reason is easier to answer than a blanket no.

  • Address the technical objections directly — metering, load management, cable routing, and RCD Type B protection.

  • Reframe it as a building-wide amenity rather than a personal request. Committees respond better to a proposal that benefits all residents and can generate income for the building.

  • Bring in a specialist to present to the committee. Most refusals come from unfamiliarity, and a technical presentation resolves more objections than a resident arguing alone.

  • If a refusal seems unreasonable, formal dispute routes exist under Malaysian strata law.

In practice, most refusals are reversed by a better proposal rather than by escalation. That is why we offer to present directly to your JMB or Management Corporation — contact us for a site assessment.

Getting approval: private bay vs communal

How you get approved depends entirely on which of two projects you are doing. A private bay for one resident is straightforward. A communal, building-wide system is a larger process. Treating them as the same is the single most common source of confusion.

Private bay (single resident) — the straightforward path

For a private charger at your own bay, only one approval matters: your management office's (JMB or MC) written consent. They cannot refuse without documented, reasonable grounds. There is no EVCS licence, no ST/CPO registration, and no Bomba submission for a private bay. Three steps:

  1. Request consent. The owner sends a short written request. EvGuru provides a templated application letter that pre-empts the usual questions (charger type, load, insurance, installer credentials).

  2. Management office approves. The office grants written consent — occasionally with reasonable conditions such as working hours. That's the whole of the "permission" layer.

  3. EvGuru installs. A 4–8 hour install, TNB/electrical submission handled by a competent person, full commissioning test, and a completion certificate to both owner and office.

Typical timeline: a few days to a couple of weeks — almost all of it simply waiting for the office to respond. The install itself is a single working day.

Communal / building-wide rollout — the full process

A JMB-owned or developer-led system serving multiple residents (shared chargers, visitor bays, revenue collection) follows the longer process below.

  1. JMB decision and mandate. The committee resolves to proceed (often a special resolution at AGM/EGM) and adds an EV by-law. We provide a one-page board paper and a draft by-law.

  2. Feasibility and evidence pack. Installer credentials, certifications, single-line diagram, riser/transformer load study, insurance, indemnity. We provide a free 15-minute committee briefing and a worked feasibility study.

  3. Site survey. Joint walk with the M&E team: riser/DB capacity, cable route, EVCB position versus fire egress. We schedule directly with the building's electrical contractor.

  4. Scope, billing model and conditions. Charger count, DLM topology, OCPP back-office, and billing model agreed and written into the consent. We model each billing option so the committee decides on numbers, not opinions.

  5. ST/CPO registration and TNB supply. Communal and public-access chargers require CPO registration, and a TNB supply review is run. A phased 7kW plus DLM path stays within existing headroom where possible.

  6. Phased install, commissioning and hand-over. Installed in phases, each commissioned with a test report; OCPP configured; completion certificates and an operations pack handed over, including test readings signed by an ST-certified installer and a maintenance plan.

First-time JMBs typically run 4–6 weeks end-to-end; buildings with a previous install, 2–3 weeks. Across the Mont Kiara, Bangsar South, Damansara Heights, Cyberjaya, KL Eco City, and KLCC corridors we are already on the approved-installer list at a growing number of buildings.

What EvGuru actually does: for a private bay, we draft the consent letter, handle the TNB/electrical submission, install, and hand over the documentation — the owner signs one or two documents. For a communal rollout, we prepare the board paper and by-law, run the feasibility study and committee briefing, manage the survey, model the billing options, file ST/CPO and TNB submissions, and install in phases. That is what "we handle the paperwork end-to-end" means.
